1. Introduction and Acceptance

These Terms and Conditions constitute a legally binding agreement between you (the "Renter" or "You") and Crest Motors (the "Company," "We," "Us," or "Our"), governing your use of our luxury car rental services in Taiwan. By making a reservation, signing a rental agreement, or using our vehicles, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with any part of these terms, please do not proceed with renting a vehicle from us. These terms supplement and do not replace the specific rental agreement you sign at the time of vehicle pickup.

2. Definitions

For the purposes of these Terms and Conditions:

  • Service: The luxury car rental services provided by Crest Motors, including vehicle provision, insurance coverage, customer support, and related offerings
  • Renter or You: The individual or entity entering into a rental agreement with Crest Motors
  • Vehicle: Any automobile rented from Crest Motors under these terms
  • Rental Period: The duration from vehicle pickup to vehicle return as specified in the rental agreement
  • Agreement: These Terms and Conditions together with the signed rental contract

3. Renter Eligibility

To rent a vehicle from Crest Motors, you must:

  • Be at least 25 years of age at the time of rental
  • Hold a valid driver's license issued at least two years prior to the rental date
  • For non-Taiwan residents, possess either an International Driving Permit or a driver's license with English translation
  • Present a valid passport or national identification card
  • Provide a valid credit card in your name for security deposit purposes
  • Have the legal capacity to enter into binding contracts under Taiwan law

We reserve the right to verify eligibility and refuse rental to any individual who does not meet these requirements or who we reasonably believe poses a risk to vehicle safety or our business interests.

4. Reservations and Booking

4.1 Reservation Process

Reservations can be made through our website, email, or phone. A reservation becomes binding only upon our written confirmation. We recommend booking at least seven days in advance to ensure vehicle availability, particularly during peak travel seasons.

4.2 Vehicle Availability

While we make every effort to provide the specific vehicle model reserved, we reserve the right to substitute a vehicle of equivalent or higher category if the reserved vehicle becomes unavailable due to maintenance, accident, or other unforeseen circumstances.

4.3 Modification and Cancellation

Reservation modifications are subject to vehicle availability. Cancellations made more than 48 hours before the scheduled pickup time incur no penalty. Cancellations within 48 hours of pickup may result in a cancellation fee equal to one day's rental rate. No-show reservations forfeit any prepayment.

5. Payment Terms

5.1 Pricing and Fees

Rental rates are quoted in New Taiwan Dollars (NT$) and include comprehensive insurance, GPS navigation, 24-hour roadside assistance, and English-speaking customer support. Rates do not include fuel, which is the Renter's responsibility.

5.2 Security Deposit

A refundable security deposit will be authorized on your credit card at vehicle pickup. The amount varies by vehicle category, typically ranging from NT$30,000 to NT$100,000. The authorization is released within 7-14 business days after vehicle return, provided there are no outstanding damages or violations.

5.3 Payment Methods

We accept major credit cards (Visa, Mastercard, American Express). Cash payments may be accepted for the rental fee but do not eliminate the requirement for a credit card security deposit. Payment is due at vehicle pickup unless alternative arrangements have been confirmed in writing.

5.4 Currency and Taxes

All prices are quoted in New Taiwan Dollars and include applicable business taxes as required under Taiwan law.

6. Rental Period and Extensions

The rental period begins at the agreed pickup time and ends at the agreed return time. Late returns without prior authorization incur additional charges calculated at the daily rental rate plus a late fee. If you need to extend your rental, contact us at least 24 hours before the scheduled return time. Extensions are subject to vehicle availability and may be charged at a different rate.

Failure to return the vehicle by the agreed time without authorization may be reported to law enforcement authorities as unauthorized use.

7. Permitted and Prohibited Use

7.1 Permitted Use

The vehicle may be operated only:

  • On paved roads in Taiwan
  • By the named Renter or authorized additional drivers listed on the rental agreement
  • In compliance with all Taiwan traffic laws and regulations
  • For personal or business travel purposes as specified in the rental agreement

7.2 Prohibited Use

The vehicle must not be used for:

  • Commercial transportation of passengers or goods for hire
  • Racing, competitive driving, or off-road activities
  • Towing or pushing any vehicle or trailer
  • Transportation of hazardous materials, illegal substances, or contraband
  • Any illegal purpose or in violation of Taiwan law
  • Operation while under the influence of alcohol or controlled substances
  • Subletting or unauthorized transfer to third parties

7.3 Smoking Policy

Smoking is prohibited in all rental vehicles. Violation of this policy results in a cleaning fee of NT$5,000.

8. Insurance Coverage

8.1 Included Coverage

All rentals include comprehensive insurance covering:

  • Collision Damage Waiver (CDW) with a deductible specified in your rental agreement
  • Theft Protection (TP) with applicable deductible
  • Third-Party Liability Insurance as required by Taiwan law

8.2 Coverage Limitations

Insurance coverage is void if the vehicle is used in violation of these terms, including but not limited to:

  • Operation by an unauthorized driver
  • Use while intoxicated or under the influence of controlled substances
  • Prohibited activities as outlined in Section 7.2
  • Failure to report accidents or damages to us and relevant authorities

8.3 Renter Responsibility

The Renter remains responsible for deductibles as specified in the rental agreement and for any damages or losses not covered by insurance.

9. Accidents, Damage, and Theft

In the event of an accident, damage, or theft:

  1. Contact local police immediately and obtain an official accident report
  2. Notify Crest Motors within 2 hours of the incident
  3. Do not admit fault or liability at the scene
  4. Cooperate fully with our insurance provider's investigation
  5. Complete all required documentation accurately and promptly

Failure to report accidents or provide required documentation may void insurance coverage and result in full liability for damages.

10. Vehicle Maintenance and Care

The Renter is responsible for:

  • Checking and maintaining appropriate fluid levels
  • Ensuring tire pressure is adequate
  • Reporting any mechanical issues immediately
  • Keeping the vehicle secure when not in use
  • Returning the vehicle in the same condition as received, normal wear excepted

Do not attempt repairs without our authorization. Contact us immediately if mechanical problems arise and we will coordinate appropriate service or replacement.

11. Fuel Policy

Vehicles are provided with a full tank of fuel. The vehicle must be returned with a full tank. If returned with less than a full tank, a refueling charge will be applied based on current fuel prices plus a service fee of NT$500.

Use only the fuel type specified for the vehicle. Incorrect fuel usage resulting in damage is the Renter's responsibility and not covered by insurance.

12. Limitation of Liability

To the maximum extent permitted under Taiwan law:

  • Crest Motors is not liable for any indirect, incidental, consequential, or special damages arising from vehicle rental or use
  • We are not responsible for personal belongings left in rental vehicles
  • Our liability for direct damages is limited to the total rental fees paid for the affected rental period
  • We are not liable for delays, trip interruptions, or other travel inconveniences unless caused by our gross negligence

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence or for fraud.

13. Indemnification

You agree to indemnify and hold Crest Motors, its employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the rental vehicle, including violations of these terms, traffic violations, parking fines, and damages caused to third parties.

14. Termination of Rental

We reserve the right to terminate the rental agreement and repossess the vehicle without notice if:

  • The vehicle is used in violation of these terms
  • Payment obligations are not met
  • We reasonably believe the vehicle is being used unsafely or illegally
  • The Renter provides false or misleading information

No refund is provided for early termination due to breach of these terms.

15. Dispute Resolution

15.1 Governing Law

These Terms and Conditions are governed by the laws of Taiwan, Republic of China. Any disputes arising from or relating to these terms will be subject to the exclusive jurisdiction of the courts of Taipei, Taiwan.

15.2 Informal Resolution

We encourage addressing disputes through direct communication first. Please contact us at [email protected] with concerns, and we will work in good faith toward resolution.

16. General Provisions

16.1 Entire Agreement

These Terms and Conditions, together with the signed rental agreement, constitute the entire agreement between you and Crest Motors regarding vehicle rental services.

16.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

16.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it in the future.

16.4 Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to any successor entity.

17. Changes to These Terms

We may update these Terms and Conditions periodically. Changes become effective upon posting to our website with an updated "Last Updated" date. Significant changes will be communicated via email to registered users.

Your continued use of our services after changes are posted constitutes acceptance of the modified terms. The terms in effect at the time of your rental govern that specific rental.
